1. About these terms

Small Money Concepts is operated by Ryland Vogel as a sole proprietorship based in the State of Utah, United States. In these documents, "we", "us" and "Small Money Concepts" mean that business, and "you" means the person using the website, the course site at learn.smallmoneyconcepts.com, the Discord community, or any paid product. You can reach us at contact@smallmoneyconcepts.com.

These Terms of Service govern your access to and use of the website, the course site, the free Discord community, and every paid product we offer. By claiming the free plan, joining the Discord, purchasing a product, or otherwise using our services, you agree to these terms. If you do not agree, do not use the services. Our Return and Refund Policy, Privacy Policy and End User License Agreement form part of these terms.

2. What Small Money Concepts is, and what it is not

This is trading education. It is not financial advice.

Small Money Concepts is educational. Nothing we publish, teach, post, or say in a lesson, a live class, a live trading session, a recorded session, a chat message, a direct message, or an indicator is personalized investment advice, a recommendation to buy or sell any security or futures contract, or a solicitation. Ryland Vogel is not a registered investment adviser, a broker dealer, or a commodity trading advisor. Every trading decision you make is yours alone, made with your own money, at your own risk. If you want advice about your particular financial circumstances, consult a licensed professional.

Trading futures involves substantial risk of loss and is not suitable for every investor. You can lose more than your initial investment. Past performance, whether ours or any student's, is not indicative of future results. Any payout figures or student results shown on our website or in our materials describe what specific individuals achieved, are shared with their permission, are not typical, and are not a promise, projection, or guarantee of what you will achieve. Most people who attempt to trade lose money.

3. Your own risk

You are responsible for your own risk management. We cannot prevent anyone from over leveraging an account, ignoring a stop loss, or trading money they cannot afford to lose, and we accept no responsibility for losses that result when someone does. Practice on the course site, demo accounts and evaluation accounts is practice. A result there says nothing certain about how you will do with real money.

4. Eligibility

You must be at least 18 years old to claim any plan, purchase any product, or join the community. By using the services you represent that you are 18 or older and that you are legally permitted to use them where you live.

5. What we offer

The exact contents of each product are described on our website and product pages at the time you buy. We may add to, change or retire material, sessions and features over time.

6. Purchases, billing and renewal

Paid products are sold and processed through Whop. When you buy through Whop you are also subject to Whop's own terms. We do not see or store your full payment card details at any point.

We may change our prices at any time. A price change never applies to a period you have already paid for, and we will give notice before a new price applies to an existing subscription.

7. The Mentorship three-month benefit

If you pay for three monthly Mentorship periods, you keep access to the SMC Course and the Live Room for twelve months from the date of your third payment, even if you cancel Mentorship. This benefit is personal to you, does not apply to payments that are refunded or charged back, and is granted by us after your third payment.

8. Refunds

All sales are final once digital access has been delivered. Our Return and Refund Policy is the full statement of our position, including the narrow situations where we will make things right.

9. Lifetime members

We no longer sell lifetime access. Existing lifetime members keep their access on the terms they bought under. Where those terms did not define "lifetime", it means the operating lifetime of Small Money Concepts, not your lifetime. If the business ceases operation, lifetime access ends with it and no refund is owed. We will give reasonable notice if that ever happens.

10. The course site and your account

Paid course access is tied to the Whop account you paid with. You sign in to the course site with that account, and your progress and practice results are saved to it. Anyone may look around the course site without signing in. Lessons unlock according to your plan.

Your access is personal to you. You are responsible for everything done under your account and for keeping your credentials secure.

11. Live sessions, classes, analysis and schedule

We publish an intended schedule for live trading, classes and market analysis, and we make a good faith effort to keep to it. Schedules can move and sessions can be missed, and some mornings there is no trade. We do not guarantee that any particular session, class, recording, analysis, or post will occur on any particular day, and a missed or rescheduled session is not grounds for a refund.

12. Recordings

Classes and live sessions may be recorded and made available to members. If you speak on the mic or post in a session, that may appear in recordings available to members. We will not use your name, face or voice in public marketing without your permission.

13. Your conduct

While using the community you agree not to: - Share, resell, stream, record, or redistribute any part of the paid material, or give another person access to your account. - Harass, threaten, or abuse any member, student, or staff. - Solicit members for other paid programs, signal groups, or services without our written permission. - Give personalized financial advice to other members, or represent yourself as speaking for Small Money Concepts. - Post another person's private information. - Post fake results or someone else's results as your own. - Use the services for anything unlawful.

14. Creators and affiliates

If you promote Small Money Concepts through our creator or affiliate program, you must clearly disclose that you earn a commission, must not promise anyone that they will make money, must not post fake or borrowed results, and must not run paid ads on our name without our written permission. Commission rates and payouts are handled through Whop and may change with notice. Breaking these rules ends your participation.

15. Intellectual property

All course material, lessons, practice charts, videos, class recordings, written material, checklists, indicators, scripts, graphics and other content are owned by us and are licensed to you, not sold. Your license and its limits are set out in our End User License Agreement.

16. Third party platforms

We deliver our services using platforms we do not control, including Whop, Discord, TradingView, and any charting platform or proprietary trading firm you choose to use. We are not responsible for their availability, their pricing, their policies, or any action they take against your account with them. If one of those platforms suspends you, we will make a reasonable effort to restore your access to our material by another route, but we owe no refund.

17. Suspension and termination

We may suspend or terminate your access, without refund, if you breach these terms, the EULA, or the community rules, in particular if you share or redistribute paid material. You may stop using the services at any time by cancelling your subscription.

18. Disclaimers

The services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non infringement. We do not warrant that the services will be uninterrupted, error free, or that any information will be accurate or complete.

19. Limitation of liability

To the fullest extent permitted by law, we are not liable for any trading losses, lost profits, lost opportunity, or any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the services, whatever the theory of liability, even if we were advised of the possibility. To the fullest extent permitted by law, our total aggregate liability to you for any claim relating to the services is limited to the amount you actually paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to the greatest extent permitted.

20. Indemnification

You agree to indemnify and hold harmless Ryland Vogel and Small Money Concepts from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your use of the services, your trading activity, your breach of these terms, or your violation of any law or the rights of a third party.

21. Governing law and dispute resolution

These terms are governed by the laws of the State of Utah, without regard to its conflict of law rules.

Please contact us first. Most problems are solved faster that way. Any dispute arising out of or relating to these terms or the services that we cannot resolve informally will be resolved by binding individual arbitration seated in the State of Utah, rather than in court, except that either party may bring an individual claim in small claims court. You and we each waive any right to a jury trial and any right to bring or participate in a class, collective, or representative action.

Nothing in this section limits any right you may have that cannot be waived under the law that applies to you.

22. Changes to these terms

We may update these terms. When we do, we will change the effective date at the top and post the updated version. Material changes will be announced in the community. Continuing to use the services after a change means you accept the updated terms.
